Either party may appear in person or remotely. The arbitrator's decision shall be final and binding.
If you initiate arbitration against us, your filing fee is capped at $100, regardless of the arbitration provider's standard fees. We will pay the remainder of the arbitration provider's filing and administrative fees. Each party bears its own attorneys' fees unless the arbitrator awards them.
You agree that any arbitration or legal action will be conducted on an individual basis only and not as a class action, collective action, consolidated action, or representative action. Neither you nor we may bring or participate in any class, collective, or representative proceeding against the other party. The arbitrator may not consolidate the claims of multiple persons.
You may opt out of the arbitration provision in Section 12 (but not the class action waiver) by sending written notice to info@pepmastery.com within 30 days of your first use of the Site. Your notice must include your name, the email address you used to access the Site, and a clear statement that you decline arbitration. Opting out does not affect any other provision of these Terms.
Before filing arbitration, the party with a claim must send the other party a written notice of dispute and provide 30 days to attempt to resolve the dispute informally. Send notices to info@pepmastery.com.
These Terms are governed by the laws of the State of Wisconsin, without regard to its conflict-of-laws principles. For any matter not subject to arbitration (such as small claims actions or actions to enforce an arbitration award), the exclusive venue shall be the state or federal courts located in Wisconsin, and you consent to the personal jurisdiction of those courts.
